A two-member division bench reserved the verdict which will be announced at around 5:30pm today
A ruling on the intra-court appeal filed by Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan against the jail trial in the cipher case has been reserved by the Islamabad High Court (IHC) as of Tuesday.
Judges Miangul Hassan Aurangzeb and Saman Riffat Imtiaz, who make up a division bench, have delayed the decision regarding the plea, which is expected to be made public at approximately 5:30 p.m. today.
During the hearing, Justice Aurangzeb stated that the comprehensive ruling will be issued tomorrow and that a brief order about the appeal would be announced today.
During a November 14 hearing, Khan’s jail trial in the cipher case was postponed by the high court. Judge Abual Hasnat Zulqarnain of the special court accused the PTI chairman, who is presently being held in Adiala jail.
The order from the IHC was issued subsequent to the approval of Khan and Shah Mahmood Qureshi’s jail trial by the interim federal government.
The former prime minister had already filed an IHC against the jail trial, which the court’s single bench denied on October 16. The prime minister was removed from office in April of last year as a result of a no-confidence motion.
The one-member bench led by IHC Chief Justice Aamer Farooq determined that Khan’s jail trial in the cipher matter was conducted without obvious malice. In addition, the judge told him to go to the trial court if his doubts persisted.
Khan thereafter filed an intra-court appeal against the verdict of the single bench.

Salman Akram Raja, Khan’s attorney, began the hearing by outlining his case and arguing that a jail trial must adhere to certain formalities.
Raja informed the court that an order pertaining to a jail trial ought to be issued by the court after due consideration. “Following [the order], the second stage involves the approval of the federal government on the chief commissioner’s request,” he said.
He further stated that upon cabinet approval, the administration must notify the high court.
“The cabinet has to approve the order, however, in this case, the cabinet hadn’t given any approval before November 12,” stated Raja.

The judge had written a letter to the law ministry on November 8, but Khan’s attorney informed the court that it could not be regarded as a court order.

Raja said that the judge in the letter written by the top commissioner to the home ministry and then the statute spoke about the future rather than the past.
The cabinet was then issued a summary, according to advocate Raja. “The summary which was prepared on November 10 did not include the previous jail trial,” he claimed.
According to Khan’s attorney, a notification was sent out and the trial was approved by the cabinet. “However, the judge did not ask for the approval retrospectively. He questioned, “How can the cabinet approve something the [judge] hadn’t asked for?”

Justice Aurangzeb said, “Do you think the November 13 order fulfills the legal requirements?”
Raja responded by stating that he didn’t think it was lawful because the cabinet approved it without a court ruling.
The bench postponed the next hearing until today, Tuesday.
What is ciphergate?
Less than a month before he was removed from office in April 2022, on March 27, 2022, Imran Khan stirred up controversy when he waved a letter in front of the crowd during a public rally. He claimed that the letter was a cipher case from a foreign country that had teamed up with his political rivals to pull down the PTI government.
Both the letter’s contents and the identity of the country it originated from were with held by him. But he said that Assistant Secretary of State for South and Central Asia Affairs Donald Lu had asked to have him removed a few days later, and he accused the US of plotting against him.

The Federal Investigation Agency (FIA) used Section 5 of the Official Secrets Act 1923 to book Khan and Qureshi in the cipher case in August.

Attorney-General Addresses Imran Cipher Case Jail Trial
Mansoor Usman Awan, the Attorney-General of Pakistan, then approached the dais. He emphasized that Imran’s family members were permitted to attend the proceedings even though he stated that a jail trial was not for the general public to witness.
He recalled that no physical remand was taken because Imran was incarcerated at the time of his arrest. The AGP emphasized that charges against the accused in front of him were filed in accordance with the law and stated, “If the things that exist in the law are not taking place, then you say that justice is not being served.”
The jail trial against Imran is being held because, according to Awan, the hearing is taking place in a large auditorium at Adiala Jail.
Following the conclusion of the AGP’s arguments, Justice Aurangzeb stated that the court will first give a brief order and then a lengthy one at a later time, and the bench reserved the decision.
