IHC issues a stay order against jail trail of imran khan cipher case || 2023

Imran khan cipher case, Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan was facing a jail trial.

On Tuesday, the Islamabad High Court (IHC) issued a stay order against his trial.

The court postpones the hearing until November 16 and suspends the imran khan cipher case proceedings.

The decision was announced by a two-member bench comprised of Justice Miangul Hassan Aurangzeb and Justice Saman Rafat Imtiaz while hearing an intra-court appeal by PTI chief against his trial in Adiala Jail.

Families of Imran Khan, Qureshi permitted to attend cypher trial

Attorney General Mansoor Awan made the government’s case before the court during the hearing.

He said that Imran Khan’s jail trial had been approved by the government and that the notification would be made to the court.

Following today’s proceedings was the hearing from last week, during which Barrister Salman Akram Raja, the lawyer for PTI Imran Khan, asked the IHC to hold an open court trial of the cipher case.

Raja stated at the prior hearing that “the general public, media, and accused family members should be permitted to witness the proceedings of the cipher case.”

He claimed that everyone would see that the cipher case involved no offense whatsoever

A case was filed under Sections 5 and 9 of the Official Secrets Act, 1923 against Imran Khan cipher case and Shah Mahmood Qureshi, the vice chairman of the Pakistan Turk Party.

As per the August 15 FIR, which was filed in response to the inquiry No. 111/2023’s conclusion regarding the complaint filed in the Counter Terrorism Wing (CTW), FIA,

it was discovered that the former foreign minister, Shah Mahmood Qureshi, and the prime minister, Imran khan cipher case, were involved in disseminating information from the secret classified document.

Law ministry approves jail trial in Al-Qadir case

In the meantime, a notification from the law ministry authorized Imran’s trial in the Adiala jail for offenses against the National Accountability Ordinance, 1999.

The notice was sent out just hours after an accountability court in Islamabad requested information from the National Accountability Bureau (NAB) regarding whether or not a notice for a jail hearing in the Al-Qadir Trust case against Imran had been sent out.

When the PTI chairman was first detained on May 9 in connection with the Al-Qadir Trust case, there were violent protests across the nation. Two days later, he was set free after the Supreme Court declared his arrest to be illegal.

The PTI leader was sentenced to prison in August following his conviction in the Toshakhana case. Imran khan cipher case remained behind bars despite the fact that his sentence was suspended on August 29 due to his judicial remand in the imran khan cipher case.

Expressing uncertainty about Imran’s whereabouts, Judge Bashir directed the NAB prosecutor to investigate further.

The order was specific, instructing the prosecutor to gather information on the case and determine if there had been an announcement regarding the former premier’s jail trial.

Responding to reporters’ queries about covering a jail trial, Judge Bashir advocated for transparency. He affirmed the benefit of open courts, stating that reporters should be permitted to cover the trial proceedings.
