The civil insulting case that writer E. Jean Carroll made against Donald Trump had to be put off because one juror and the parent of one of Trump’s lawyers were sick, according to U.S. District Judge Lewis Kaplan. Concerns were raised when a jury said they were sick, which led to them being sent home to take a COVID-19 test. Additionally, Alina Habba, Trump’s lawyer, got a fever after eating with her parents, one of whom got COVID-19. The hearing was put off while she and her co-counselor, Michael Madaio, were tested and found to be free of the virus.
Carroll says Trump raped her in the mid-1990s, which he strongly denies. The trial is based on this claim. A jury in May 2022 told Trump to pay $5 million to settle a defamation case that involved similar claims. Judge Kaplan said the first trial proved that Trump slandered Carroll and sexually abused her. The second trial was only about figuring out how much Carroll should be paid, and she is asking for at least $10 million.
Trump tried to appear on Wednesday because of the New Hampshire Republican primary on Tuesday because he was appealing the $5 million verdict. Roberta Kaplan, Carroll’s lawyer, was against the move because she said her client’s case was almost over. The judge put off making a ruling about Trump’s testimony, pointing out that the case is still ongoing.
Trump asked for a new trial, but Judge Kaplan turned it down because Carroll had said she deleted threatening emails after her first rape claim. Trump didn’t go to the first trial, but he did go to the jury selection and the first day of the second trial. Even though they are not required to appear, there are worries about possible problems. Last week, Trump was warned about how to behave in court. His loud claims that the hearing was a “witch hunt” and a “con job” led to warnings that he could be kicked out for being disruptive.
The delay in proceedings makes a case that was already controversial and full of court fights even more difficult to understand. The next choice about Trump’s testimony will affect the course of the trial as Carroll tries to get justice and money for the alleged abuse and defamation she suffered.
